Abstract

     The crime of desertion under Syrian law is the failure of a public employee to perform their job duties without legal justification or prior permission, which constitutes a violation of their obligations. This crime is distinct from a strike (which may be legal under certain conditions) and unlawful absence. as desertion involves intentionally stopping work, often with the intention of never returning.

Syrian law provides for criminal and civil liability for an employee who abandons their job. Criminally, they may be subject to disciplinary sanctions such as imprisonment and a fine. Civilly, they are required to pay compensation for damages resulting from their abandonment.

The administrative mechanism may require specific procedures, such as notifying the employee of the need to return, conducting an investigation to prove the crime, and ensuring the rights of defense. The employee's rights are also preserved, such as receiving financial benefits or returning to work through specific procedures, in exchange for their commitment to cooperate and present justified supporting documents. Therefore, it is necessary to strike a balance between maintaining administrative order and guaranteeing employee rights.
